Supervision
& Control
The task “supervision and control on
the implementation of labour regulations” covers
in a general sense the enforcement of the law and
issuing of rules in the field of labour affairs.
Primarily concerning labour inspections and labour
security directed at:
- Inspections and control of labour conditions
- Control of labour and security registers
- Control
of the companies’/establishments’ compliance
with the regulations of the Central Government
Ordinance on Security of 1958, particularly:
- Indoor
security (lighting, gas, drinking water etc.)
- Security when working with scaffolding, hoisting
and lifting, demolition work etc.
- Security of cisterns and technical installations
- Collecting
data regarding personnel registers, labour
provisions and labour conditions.
To conclude, the supervision of the compliance of
regulations concerning work permits is part of the
activities of the department of Supervision and Control.
The task “supervision and control of
the implementation of economic regulations” covers
in a general sense the enforcement of the law and
issuing of rules in the field of economic affairs
such as:
- The supervision of the compliance with provisions
of business regulations for companies
- The supervision of the compliance with provisions
of the beverage and HORECA ordinance, as well as
of the hotel and accommodations license, restaurant
license, bar, beer and snack license.
- The supervision of opening hours (shop closing
regulation) and noise nuisance.
- The supervision of import regulations, payment
in accordance with the regulations, inspection of
weight and measures regulations and their performance.
- The supervision of the compliance with the Price
Ordinance of 1961 where prices of goods and services
are subject to provisions (conducting of price calculations
and controls, controls on processing of economic
levies and price calculations).
- The
supervision of the compliance with maximum
prices for specific goods and articles.
The Department of Supervision and Control focuses
mainly on business licenses, HORECA licenses, work
permits, safety procedures and price indicators. An
effort is being made to organize one-time specific
inspections in coordination with the task force, which
consists of different government departments, depending
on the business visited.
Upon arrival at a company for inspection, the inspectors
will identify themselves with their badge. The inspectors
will inform the business about what they are going
to inspect e.g., the maximum prices, the beverage
and/or the horeca license, etc. The business will
be informed about what they have to adjust in order
to meet the requirments of the regulations. If a
business does not have one of the necessary licenses,
an appointment will be made with the permit department
at DEZA. A follow up inspection will be done to see
if the necessary adjustments have been done.
The
Department of Supervision and Control works in close
coordination with Labour Affairs and Immigration
in regard to permits which allow people to work.
It is the intention to more effectively control illegal
labour practices by installing a system of advice,
warnings, and eventually fines, which can amount up
to NAf. 100,000 for companies or individuals caught
allowing people to work without a work permit.
